1. MGNREGA, VB-G RAM G Act and the Constitutional Debate on Right to Work

Why in News?

The Supreme Court praised the repealed Mahatma Gandhi National Rural Employment Guarantee Act (MGNREGA) as an effective rural employment programme and observed that it was neither a freebie nor exploitation. The Court was hearing issues relating to delayed wages, minimum wages and whether the statutory guarantee of employment could be linked with Article 21 and the right to a dignified life.

The discussion has assumed greater significance after the replacement of MGNREGA by the Viksit Bharat Guarantee for Rozgar and Ajeevika Mission (Gramin) or VB-G RAM G Act. The new framework increases guaranteed employment from 100 to 125 days but also changes the financial and administrative structure of the rural employment programme.

UPSC/PCS Importance

One of the strongest topics for Polity, Governance and Social Justice because it connects Article 21, Directive Principles of State Policy, Right to Work, minimum wages, rural employment, welfare policy and Centre-State fiscal relations.

Prelims Facts

  • The Constitution does not explicitly recognise Right to Work as a Fundamental Right.
  • Article 41 directs the State to make effective provision for the right to work within its economic capacity.
  • Article 41 is part of the Directive Principles of State Policy.
  • Article 21 protects life and personal liberty and has been judicially expanded to include the right to live with dignity.
  • MGNREGA earlier guaranteed up to 100 days of wage employment to eligible rural households.
  • The new VB-G RAM G framework provides for up to 125 days of guaranteed work.
  • The new framework has also changed the Centre-State funding arrangement.
  • Minimum wages and delayed wage payments remain important labour-rights issues.

Mains Perspective

GS-II: Governance, Welfare Schemes, Social Justice and Fundamental Rights GS-III: Employment, Rural Economy and Inclusive Growth

Revision Note: Right to Work is primarily a Directive Principle, but questions of livelihood, minimum wages and dignified employment can interact with the expansive interpretation of Article 21.

2. Supreme Court Reduces Legal Practice Requirement for Judicial Service

Why in News?

The Supreme Court has retained the requirement of prior legal practice for entry into the judicial service but reduced the mandatory experience from three years to one year. The new one-year practice rule will come into full effect from 1 April 2027.

UPSC/PCS Importance

Important for judicial reforms, subordinate judiciary, recruitment of Civil Judges, quality of justice delivery, legal education and the constitutional framework governing the district and subordinate courts.

Prelims Facts

  • The decision relates to recruitment for Civil Judge or Junior Division posts.
  • The Supreme Court reduced prior legal-practice experience from three years to one year.
  • The one-year requirement will operate fully from April 1, 2027.
  • Successful candidates may undergo intensive training in State Judicial Academies.
  • Articles 233 to 237 of the Constitution deal broadly with subordinate courts.
  • District Judges are appointed by the Governor in consultation with the High Court under Article 233.
  • Control over subordinate courts is vested in the High Court under Article 235.

Mains Perspective

GS-II: Judiciary, Judicial Reforms and Administration of Justice

Revision Note: The debate is essentially about balancing fresh recruitment into the judiciary with the practical courtroom experience required for effective adjudication.

3. Reservation Reform Debate: Representation, Income and Creamy Layer

Why in News?

A protest in New Delhi called for a major overhaul of India’s reservation system. Demands included replacing caste-based reservation with income-based criteria, introducing the idea of β€œone family, one reservation” and reviewing the distribution of reservation benefits within SC, ST and OBC categories.

UPSC/PCS Importance

Extremely important for Indian Polity and Social Justice because it connects equality, affirmative action, adequate representation, creamy layer, sub-classification and constitutional reservation provisions.

Prelims Facts

  • Article 15(4) enables special provisions for socially and educationally backward classes and SCs/STs.
  • Article 15(5) relates to reservation in educational institutions subject to constitutional conditions.
  • Article 16(4) permits reservation in public employment for inadequately represented backward classes.
  • Article 16(4A) relates to reservation in promotion for SCs and STs.
  • Article 16(4B) deals with carrying forward unfilled reserved vacancies.
  • The creamy-layer principle is strongly associated with the Indra Sawhney judgment.
  • Reservation is constitutionally connected with representation and substantive equality, not merely poverty alleviation.
  • Sub-classification within reserved categories has emerged as an important constitutional issue.

Mains Perspective

GS-II: Constitution, Social Justice, Equality and Affirmative Action

Revision Note: Reservation policy is rooted in the idea of correcting structural exclusion and ensuring adequate representation; economic disadvantage is only one dimension of inequality.

4. Cauvery Water Crisis: Federalism Meets Climate Stress

Why in News?

Poor rainfall and declining reservoir storage have intensified pressure across the Cauvery basin. Karnataka faces the challenge of balancing irrigation and drinking-water requirements, while Tamil Nadu is seeking its legally mandated share for agriculture in the Cauvery delta.

  • Groundwater depletion and salinity ingress are emerging concerns in parts of the delta.

Mains Perspective

GS-II: Federalism and Inter-State Relations GS-III: Agriculture, Water Resources and Climate Change

Revision Note: Climate-induced water stress can intensify existing federal disputes, making basin-level planning, scientific water management and cooperative institutions increasingly important.

5. Piracy in Gulf of Aden and Somalia: India’s Maritime Security Challenge

Why in News?

Two commercial vessels carrying a total of 22 Indian nationals were hijacked in separate piracy incidents near Yemen and Somalia. The incidents highlight renewed threats to merchant shipping in the Gulf of Aden, Red Sea and wider Indian Ocean region.

UPSC/PCS Importance

  • The Red Sea connects with the Mediterranean Sea through the Suez Canal.
  • Somalia lies along strategically important sea routes in the western Indian Ocean.
  • Piracy threatens commercial shipping, energy transport and global supply chains.

  • India is one of the world’s major suppliers of merchant seafarers.

Mains Perspective

Revision Note: India’s dependence on maritime trade makes security in the Arabian Sea, Gulf of Aden, Red Sea and Indian Ocean essential for economic and national security.
