1. Supreme Court on Definition of ‘Industry’: Triple Test and Industrial Relations Code

Why in News?

A nine-judge Bench of the Supreme Court has delivered an important judgment concerning the legal definition of “industry” and the landmark Bangalore Water Supply and Sewerage Board v. A. Rajappa (1978) judgment.

The Court retained the famous Triple Test for disputes pending under the old Industrial Disputes Act, 1947, but held that the Bangalore Water Supply judgment will not automatically become the controlling interpretative framework for Section 2(p) of the Industrial Relations Code, 2020.

UPSC/PCS Importance

Extremely important for Labour Reforms, Industrial Relations, Social Justice, Workers’ Rights and Judicial Interpretation.

Prelims Facts

  • Bangalore Water Supply and Sewerage Board v. A. Rajappa was decided in 1978.
  • The judgment evolved the famous Triple Test for identifying an “industry”.
  • First condition: systematic activity.
  • Second condition: cooperation between employer and employee.
  • Third condition: production or distribution of goods or services to satisfy human wants.
  • Profit motive is not essential for an activity to qualify as an industry.
  • Core sovereign functions are generally treated differently.
  • The Industrial Relations Code, 2020 contains its own definition of “industry” under Section 2(p).

Mains Perspective

GS-II: Social Justice and Rights of Workers

GS-III: Labour Reforms, Employment and Industrial Relations

Revision Note: The meaning assigned to “industry” determines the range of workers and establishments covered by labour-law protections and restrictions.

4. Kaziranga National Park: Supreme Court Panel Raises Concerns over Mining

Why in News?

A Supreme Court-constituted Central Empowered Committee (CEC) has criticised the Assam government’s handling of mining activities near the southern boundary of Kaziranga National Park.

Concerns relate particularly to the Parkup Pahar Range, Karbi Anglong hills, river catchments and important animal corridors.

UPSC/PCS Importance

Highly relevant for Environment, Biodiversity, Protected Areas, Eco-Sensitive Zones, Wildlife Corridors and Environmental Governance.

  • Wildlife corridors allow animals to move between habitats.
  • Mining and construction near protected-area corridors can fragment wildlife habitats.
  • The Central Empowered Committee assists the Supreme Court in important environmental matters.

Mains Perspective

GS-III: Biodiversity, Protected Areas and Environmental Conservation

Revision Note: Wildlife conservation requires protection not only of national parks themselves but also of surrounding catchments, corridors and ecological linkages.

5. IN-SPACe Issues India’s First Planned Space Re-entry Guidelines

Why in News?

India’s space regulator IN-SPACe has released guidelines for planned re-entry of spacecraft and launch vehicle components.

The guidelines introduce requirements relating to risk assessment, fragmentation analysis, third-party liability, insurance and advance regulatory permissions.

📰 Editorial Focus – Triple Test, Labour Rights and the Meaning of ‘Industry’

Editorial Theme

The editorial examines the Supreme Court’s treatment of the Bangalore Water Supply Triple Test and argues that the broad interpretation of “industry” created in 1978 remains relevant even under today’s changing labour market.

The central question is whether a change from the Industrial Disputes Act, 1947 to the Industrial Relations Code, 2020 should automatically lead to a narrower understanding of which establishments qualify as industries.

What is the Triple Test?

  • Systematic activity
  • Cooperation between employer and employee
  • Production or distribution of goods or services to satisfy human wants

Why is the Debate Important?

A broad definition of “industry” can bring a larger number of workers within labour-law protection. At the same time, labour law also imposes obligations on employees and regulates matters such as strikes, retrenchment and closure.

Key Concepts for UPSC

  • Bangalore Water Supply Case, 1978
  • Triple Test
  • Industrial Disputes Act, 1947
  • Industrial Relations Code, 2020
  • Section 2(p)
  • Labour Rights
  • Sovereign Functions
  • Judicial Interpretation
  • Industrial Peace
  • Social Justice

Mains Takeaway: Labour-law reform should balance flexibility for employers with adequate protection for workers. Judicial interpretation becomes especially important when new legislation retains concepts developed under earlier laws.

🌱 Prelims Concept – The “Barren-Land Fallacy”

What is it?

The barren-land fallacy is the mistaken assumption that any land without tree cover is ecologically degraded and should therefore be converted into forest.

Grasslands, savannahs, scrublands, wetlands and deserts can be naturally occurring and highly valuable ecosystems.

UPSC Takeaway

  • Afforestation is not suitable for every ecosystem.
  • Native grasslands are not degraded forests.
  • Wrong tree species can damage local water availability.
  • Ecological restoration means restoring the ecosystem naturally suited to a region.
  • Eucalyptus plantations can create problems in water-stressed regions.

Prelims Trap: More tree cover does not automatically mean better ecological restoration.
