1. Supreme Court Clarifies Police Remand under BNSS

Why in News?

The Supreme Court has clarified the scope of police custody under the Bharatiya Nagarik Suraksha Sanhita (BNSS). The Court held that the statutory scheme permits police custody of up to 15 days in the whole, which may be taken in parts within the legally prescribed initial investigation window.

Extremely important for criminal justice reforms, arrest and detention, police custody, judicial custody, default bail, rights of accused persons and the transition from CrPC to BNSS.

Prelims Facts

  • Section 58 of BNSS deals with the general 24-hour limit on detention without a Magistrate’s authorisation.
