3. Forest Rights Act and Gram Sabha Consent for Forest Diversion
Why in News?
The Union Ministry of Tribal Affairs has said that the Forest Rights Act, 2006 does not itself contain a specific provision requiring Gram Sabha consent for Stage-II forest clearance.
However, government rules and guidelines governing forest diversion require completion of the FRA process before forest land can formally be diverted for non-forest purposes.
These procedures involve identification of possible FRA claimants, recognition and vesting of rights and obtaining a No-Objection Certificate from the concerned Gram Sabhas.
A Parliamentary Committee examining NHPC projects said that average forest-clearance time for projects was 106 months and discussed whether consent from 70-75% of affected Gram Sabhas could be sufficient for major hydropower projects.

Why in News?
Karnataka has approached the Cauvery Water Management Authority (CWMA) seeking a reduction in daily water releases to Tamil Nadu.

Earlier, the Cauvery Water Regulation Committee (CWRC) had directed Karnataka to ensure flows of 9,000 cusecs per day for 15 days at the Biligundlu water gauge on the inter-State border.

Important Points
- The Forest Rights Act was enacted in 2006.
- It covers Scheduled Tribes and Other Traditional Forest Dwellers.
- The Ministry of Tribal Affairs is the nodal Ministry for the law.
