1. Supreme Court Clarifies Police Remand under BNSS
Why in News?
The Supreme Court has clarified the scope of police custody under the Bharatiya Nagarik Suraksha Sanhita (BNSS). The Court held that the statutory scheme permits police custody of up to 15 days in the whole, which may be taken in parts within the legally prescribed initial investigation window.

Extremely important for criminal justice reforms, arrest and detention, police custody, judicial custody, default bail, rights of accused persons and the transition from CrPC to BNSS.
Prelims Facts
- Section 58 of BNSS deals with the general 24-hour limit on detention without a Magistrate’s authorisation.
- Section 187 of BNSS deals with remand when investigation cannot be completed within 24 hours.
- Police custody may not exceed 15 days in the whole.
- BNSS allows the 15 days of police custody to be used in parts within the prescribed 40-day or 60-day window, depending on the case.
- For serious offences, investigation may extend up to 90 days before default bail becomes relevant; for other offences, the period is generally 60 days.
- Section 38 provides a right to meet an advocate during interrogation, though not necessarily throughout the entire interrogation.

The Lok Sabha adopted a motion referring the Foreign Contribution (Regulation) Amendment Bill, 2026 to a Joint Parliamentary Committee amid opposition concerns regarding its impact on NGOs and minority-run institutions.
